Chapter 8 - The Emergency Hearing

Judge Aris Thorne was not a man known for his patience. He presided over Family Court Room 302 with an iron fist and a perpetual scowl.

On Monday morning, the courtroom was silent and suffocatingly tense. Evan sat at the respondent's table, wearing a charcoal gray suit that made him look every inch the imposing CEO he was. Leah sat beside him, looking elegant and fragile in a modest black dress, her arm secured in a fresh, medical-grade sling.

Across the aisle, Richard and Eleanor Mercer sat with their high-priced attorney, Arthur Sterling. Sabrina sat directly behind them in the gallery, wearing a tasteful, conservative beige suit, her bruised face fully visible to garner maximum sympathy.

"This is an emergency petition for temporary custody of minor child, Eleanor 'Ellie' Walker," Judge Thorne announced, shuffling the thick stack of papers on his desk. "Petitioners Richard and Eleanor Mercer claim the mother, Leah Walker, is an unfit and violent danger to the child, currently under criminal investigation. Mr. Sterling, you may proceed."

Sterling stood up, buttoning his expensive suit. "Your Honor, this is a tragic case of parental alienation and physical endangerment. My clients discovered they had a granddaughter only two days ago. They also discovered this child is living with a woman who viciously attacked an innocent bystander, Sabrina Hayes, in a jealous, unprovoked rage. We are asking for immediate placement of the child with the grandparents until Ms. Walker’s criminal trial."

"Thank you, counselor," Judge Thorne said neutrally. He turned his gaze to Marcus. "Mr. Vance. Your response?"

Marcus stood up slowly, a calm, terrifying confidence radiating from him. "Your Honor, the respondents agree that this is a tragic case. But the danger to the child does not come from her mother. It comes from the petitioners' star witness, Sabrina Hayes."

Sterling objected immediately. "Your Honor, Ms. Hayes is the victim of a brutal assault!"

"Then let's hear from the victim," Marcus countered smoothly. "I call Sabrina Hayes to the stand."

A murmur rippled through the courtroom. Sabrina looked momentarily panicked, glancing at Richard Mercer, who nodded encouragingly. She stood up, smoothing her skirt, and walked to the witness box. She placed her hand on the Bible and swore to tell the whole truth.

"Ms. Hayes," Marcus began, pacing slowly in front of the stand. "Can you tell the court what happened on the night of August 1st?"

Sabrina sniffled, a single, perfect tear rolling down her unbruised cheek. "I went to Evan's house to surprise him. When I walked in, Leah was there. She went crazy. She grabbed a hockey stick and started screaming that Evan was hers. She swung it at my face. I barely escaped with my life."

"A harrowing tale," Marcus said dryly. "And you reported this to the police?"

"Yes. Immediately."

"And the injuries on your face today... those were caused by Leah Walker swinging a wooden hockey stick?"

"Yes," Sabrina said firmly, her voice trembling with manufactured emotion. "The doctor at the ER documented it."

"I see." Marcus stopped pacing. He walked over to his table and picked up a tablet. "Your Honor, I would like to submit Exhibit C into evidence. It is a video file retrieved by a licensed private investigator, authenticated by timestamp and location data."

Sterling jumped up. "Objection! Surprise evidence!"

"I submitted it to the clerk ten minutes before the hearing, Your Honor," Marcus said smoothly. "Counsel is welcome to review it on the screen."

Judge Thorne waved his hand. "Overruled. Play the video, Mr. Vance."

Marcus connected the tablet to the courtroom monitor. The screen flickered to life.

The entire courtroom watched in absolute, stunned silence as Sabrina’s sleek BMW pulled into her driveway. They watched her step out, retrieve the metal tire iron, and violently strike her own face. Twice.

A collective gasp echoed through the gallery. Eleanor Mercer’s hand flew to her pearls, her face turning chalk-white. Richard stared at the screen, his jaw practically unhinged.

On the witness stand, Sabrina turned the color of ash.

"Ms. Hayes," Marcus’s voice cracked through the silence like a whip. "Would you like to revise your previous testimony under oath? Or shall I have the bailiff arrest you for perjury right now?"

"I... I..." Sabrina stammered, her eyes darting frantically around the room for an exit. "It's a deep fake! That's not me!"

"It was pulled directly from a hardwired security system across the street, authenticated by the homeowner," Marcus shot back. "Furthermore, Your Honor, we have submitted the medical records from Leah Walker's surgeon. Ms. Walker sustained a comminuted fracture of the clavicle, caused by massive downward blunt force trauma. Trauma inflicted by Ms. Hayes swinging a hockey stick at my client's four-year-old daughter."

Judge Thorne's face turned thunderous. He slammed his gavel down so hard it echoed like a gunshot.

"Ms. Hayes," the judge boomed, his voice dripping with absolute disgust. "You have not only lied to this court, but you have attempted to weaponize the legal system to steal a child based on fabricated evidence."

Judge Thorne looked past Sabrina, directly at Richard and Eleanor Mercer.

"Your petition for emergency custody is denied with prejudice," the judge spat. "You will never file for custody in my courtroom again. Furthermore, Mr. Mercer, you now share full, immediate joint legal and physical custody with Ms. Walker."

Evan reached under the table, grabbing Leah’s hand and squeezing it tightly. She was crying, but this time, they were tears of pure, unadulterated relief.

"As for you, Ms. Hayes," Judge Thorne continued, glaring at the witness stand. "Bailiff. Remand the witness into custody. She is under arrest for perjury, and I will personally be forwarding this video to the District Attorney to file aggravated assault charges."

Two armed bailiffs approached the stand.

Sabrina let out a guttural, unhinged scream. "No! You can't do this! Evan! Evan, tell them!"

She lunged over the wooden barrier of the witness stand, trying to get to Evan, but the bailiffs tackled her instantly, wrestling her arms behind her back. Handcuffs clicked loudly over her wrists.

"It's over, Sabrina," Evan said coldly, not moving an inch as they dragged her past his table. "Have a nice life."
